Terms of Service

1. Acceptance

By creating an account, accessing the admin console, or using any InsightGap service (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

InsightGap provides a restaurant operations platform: an AI phone assistant, a review management console, CRM tooling, and related features. Availability, features, and pricing may change over time.

3. Your account

You are responsible for keeping your login credentials confidential and for everything that happens under your account. Notify us immediately of any unauthorized access. You represent that you are authorized to act on behalf of the business you onboard.

5. Call recording and AI handling

When enabled, the Service may record inbound phone calls and route them through an automated assistant. We disclose this to callers at the start of each call. You are responsible for any additional notice or consent required in your jurisdiction (for example, all-party-consent states).

6. Customer data

You retain ownership of the business, menu, and customer data you provide. You grant us a limited license to process that data solely to operate the Service on your behalf.

7. Subscriptions and billing

Paid services are billed in advance on a recurring basis unless otherwise stated. You may cancel future renewals at any time from your account. Fees already paid are non-refundable except where required by law.

8. Third-party services

The Service integrates with third parties (for example, Twilio, Google, Stripe). Your use of those integrations is subject to their own terms. We are not responsible for outages or policy changes at third parties.

9. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or that pose a security, legal, or financial risk.

10. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, InsightGap will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the twelve months preceding the claim.

12. Changes

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use after the effective date constitutes acceptance.
